Limitation of Liability : To the extent permitted by law and subject solely to any exceptions outlined in these conditions: (1) One Earth Australia Pty Ltd trading as One Earth Spill Kits Australia (One Earth) bears no responsibility to the Buyer for any form of indirect loss, damage, or expense (including consequential loss) incurred by the Buyer or any other party arising from the supply of goods by One Earth, the use or performance of the goods, any breach by One Earth of these terms and conditions, or the negligence of One Earth; and (2) The One Earth’s liability for direct losses is capped at an amount equivalent to the actual sum paid by the Buyer to One Earth (after deducting all discounts and refunds) concerning the goods related to the liability in question.
